1. Identification of the Store

Jewellery byMZ, hereinafter referred to as “byMZ”, is responsible for the website and for the sale of the jewellery items made available therein. “byMZ” contact details, registered address and company information are provided below.

2. Purpose

These Terms and Conditions govern the use of this website and the commercial transactions carried out between “byMZ” and its customers. By using this website or placing an order, the customer fully accepts these Terms and Conditions.
“byMZ” reserves the right to update or modify these Terms and Conditions without prior notice. Customer are advised to periodically review the Terms and Conditions to keep updated of any changes.

3. Product information

All items offered are made of sterling silver 925 (or another alloy as specified in the product description).
Product images are for illustrative purposes only. Slight variations may occur in the delivered product, especially for handcrafted items.
Due to the artisanal nature of the jewellery, items may display minor marks, variations or irregularities that are inherent to handcrafted production. These characteristics are intentional, form part of the design, and shall not be considered defects.
“byMZ” reserves the right to update prices, change product details, or withdraw items from sale without prior notice.

4. Prices and Payment

All prices are shown in Euros (€) and include VAT at the legal rate in Portugal, unless otherwise indicated.
Shipping costs are displayed before checkout and added to the final price.
Accepted payment methods include Debit/Credit Card, PayPal, Multibanco, MBWay, PayShop, Google Pay, and Apple Pay.

5. Orders and Shipping

Orders will only be processed once full payment has been received.
The average shipping time is 5 working days, but this may vary in the case of customised items or stock shortages.
Delivery deadlines depend on the customer address and “byMZ” cannot be held responsible for delays attributable to third-party logistics services.

6. Right of Withdrawal and Returns

In accordance with Portuguese legislation on e-commerce, customers are entitled to withdraw from the contract and return their order within 14 days of receipt, except for customised or made-to-order items.
Returned items must be unused, in perfect condition, and in the original packaging.
Return shipping costs are the responsibility of the customer, unless the return is due to a defect or an error on the part of “byMZ”.
The customer is solely responsible for the return of the items, including all costs and risks involved. “byMZ” shall not be held liable for any loss, damage, delay, or misdelivery occurring during return shipping. Customers are advised to use a trackable and insured shipping method.
To request an exchange or return, please contact us using the contact form and briefly explain the reason for your request.
Returns of Gift Cards are not accepted.

7. Warranty

All products are covered by a statutory warranty under Decree-Law No. 67/2003, as amended by Decree-Law No. 84/2021., as established by Portuguese law.
The warranty does not cover damage caused by misuse, accidental drops, natural wear and tear, improper cleaning, or exposure to chemicals.

8. Liability

By creating and using an account on “byMZ” customers are responsible for maintaining the confidentiality of their account details and any activities originating from their account.
“byMZ” shall not be held liable for: technical failures or third-party issues affecting website access; direct or indirect damages arising from the use or inability to use the products or services.
“byMZ” shall not be held liable for delays, non-performance, or damages resulting from events of force majeure (e.g., natural disasters, strikes, technical failures) affecting order deliveries.

9. Data Protection

Personal data provided by customers are used exclusively for the processing of orders and related communication.
The Store guarantees confidentiality and the secure handling of personal data, in compliance with the EU General Data Protection Regulation (GDPR).
Customers may, at any time, request access to, rectification, or deletion of their personal data.

10. Governing Law and Dispute Resolution

These Terms and Conditions are governed exclusively by Portuguese law.
In the event of a dispute, customers may resort to the competent Portuguese courts.

11. Intellectual Property

All content available on this website, including but not limited to texts, images, product descriptions, logos, designs, and trademarks, is the exclusive property of “byMZ”.
Customers and website users are not authorised to copy, reproduce, modify, distribute, transmit, display, or otherwise use any of the content for commercial purposes without prior written consent from “byMZ”.
Any unauthorised use of the content may give rise to legal action in accordance with applicable legislation.
